Consular Announcement

When an individual makes a visa application, only a U.S. consular officer reviews the facts of the case and makes a determination of eligibility based on U.S. law. All visa applications are reviewed individually in accordance with the requirements of the Immigration and Nationality Act and other relevant laws, which establish detailed standards for determining eligibility for visas and admission to the United States. Individuals must demonstrate that they qualify for the nonimmigrant visa category in which they have applied. U.S. consular officers are trained to determine if the applicant overcomes the presumption of intending immigrant and if their circumstances would compel their return to their home country after a temporary stay in the United States.
